Fundamental responsibility of the Judiciary

The Judiciary should always remain conscious of the fact that it is undoubtedly independent in taking its decision and passing its verdicts strictly in accordance with the law but it has no existence independent of the government. It is very much part of the government. Nevertheless it holds a junior position in that partnership. It is as much responsible for the smooth running of the government as any other department. It is party to the failure or the success of the government. Instead of creating new difficulties it should shoot the running problems of the government.

The Judges should exercise utmost care while taking suo moto actions. The Judiciary should pursue a coherent policy in this regard. While the judges are within their rights to continue taking such actions, it would be advisable that Judiciary should first put its own house in order before worrying about others. How many judges, for instance, have been taken to task for building mountains of pending cases and how much corruption has been generated by delaying cases, giving unjustifiable decisions and decisions given under influence and pressures. How many cases were entertained that the judges concerned knew to be false and how many such social culprits were put behind the bar to purge the society of the black sheep. How many cases of senior judges were probed into whom the higher ups knew to be guilty of corruption.
